Sec 32-1171. Workers' compensation violation; license suspension; complaints; summary suspension

  • A. Notwithstanding any other law, if the registrar finds that a general remodeling and repair contractor as prescribed by rule adopted by the registrar fails to secure workers' compensation pursuant to title 23, chapter 6, article 4, the registrar shall order a summary suspension of the contractor's license pending proceedings for revocation or other action. The registrar shall serve the licensee with a written notice of complaint and formal hearing, setting forth the charges made against the licensee and the licensee's right to a formal hearing before the registrar pursuant to title 41, chapter 6, article 10.

    B. A general remodeling and repair contractor as prescribed by rule adopted by the registrar who is the subject of at least five unresolved and substantiated abandonment complaints as determined by the registrar in a twelve month period shall not accept new projects until the number of unresolved and substantiated abandonment complaints relating to the contractor's work performance is below five in a twelve month period.

    C. Notwithstanding section 32-1154, if the registrar finds, based on its investigation, that the public health and safety requires immediate action, the registrar shall order a summary suspension of a general remodeling and repair contractor license as prescribed by rule adopted by the registrar pending proceedings for revocation or other action. The registrar shall serve the licensee with a written notice of complaint and formal hearing, setting forth the charges made against the licensee and the licensee's right to a formal hearing before the registrar pursuant to title 41, chapter 6, article 10.
